PUBLIC PROCUREMENT 2027: key changes, reforms and working algorithms

The main changes in the structure of the new Law and complete information about the changes planned for adoption in subordinate legal acts, namely:

• New conditions in the planning process:

— which additional document the Customer is obliged to post together with the annual procurement plan if the source of financing consists of the republican and local budgets;

The updated list of UNSTRU codes by priority in 2026-2027.

The NCT — National Catalogue of Goods and its application in public procurement.

• Additional grounds for restricting the participation of potential suppliers in public procurement are being introduced;
• New in the qualification requirements.
• Retention of the main methods of carrying out public procurement, but taking into account additions and changes to them:
• Tender; Procurement by the tender method is recognised as having taken place if one application is submitted for participation in the tender that meets the qualification requirements and/ or the requirements of the tender documentation.
• Auction;
• Request for price quotations — 8,000 MCI;
• Single source;
• Through the electronic store — 4,000 MCI; Introducing a price-quotation security deposit. Mandatory preliminary order when procuring goods over 500 MCI.
• Tender-method procurement on the www.goszakup.gov.kz portal
• Qualification requirements and the technical specification. Restrictions and mandatory requirements.
• Preparing and submitting an application for participation in the electronic tender;
• Which documents are mandatory to submit and which are not. What has changed in 2026 and 2027;
• Reviewing an application for participation in the electronic tender. Current deadlines and procedures;
• Grounds for rejection, with the changes;
• Conditional discounts. Which documents are mandatory to obtain conditional discounts? New conditional discounts, changes in calculating conditional discounts when procuring goods, works and services in 2026-2027;
• Dumping and anti-dumping measures with the changes for 2026-2027;
• Current grounds and consequences of recognising public procurement by the tender method as not having taken place;
• The procedure for appealing the actions of the Tender Commission and/ or the results of the Tender. Court practice, current problems in enforcing court decisions.

• New in supporting domestic producers:
• Extending the period for delivering goods under the contract from 15 to 60 calendar days for domestic producers;
• Reducing the payment period for delivered goods from 30 calendar days to 10 working days for domestic producers;
• Increasing the amount of the advance payment from 30% to 50% for domestic producers;
• Assigning a new conditional discount of 3 (three) % if the potential supplier is in the register of Kazakhstani producers.
• Establishing new grounds for amending the concluded contract — a detailed review of all 18 grounds for concluding an additional agreement.
• Introducing additional grounds for holding the Customer to administrative liability.
• Liability of customers and organisers. Desk control. Administrative liability of officials in 2026-2027.
• The supplier's liability for breaching a public procurement contract.
